In this personal injury tort case, plaintiffs sued to recover damages for the death of their infant daughter due to a falling tree limb in Central Park, as well as for damages to cover injuries sustained by plaintiff, the mother of the child who was also injured. Defendants requested, in part, “”LinkedIn” records … [and] website or social media records” from the adult plaintiff. Plaintiffs filed for a protective order with the court. The trial court granted plaintiffs' request against some of defendant’s discovery demands, including the majority of the adult plaintiff's LinkedIn account and other social media accounts.
The court used a two-prong analysis for determining whether social media accounts are discoverable:
(1) Whether the content in the accounts is material and necessary, and
(2) Whether the production of this content would result in a violation of the account holder’s privacy rights.
Defendant requested the entirety of plaintiff's LinkedIn account to discover the truth of herclaims of being “totally” and “partially disabled” from working since the accident. Because the suit involved personal injury and disability only, the court ruled that defendant may only “obtain information pertaining to plaintiff’s communications with recruiters and others, related to job offers and inquiries, searches, and responses, if any, available on her LinkedIn account” to help determine damages. Other information on LinkedIn, such as plaintiff’s communications with her former colleagues, was not relevant in this action.
As to the broad social media discovery requests, the court commented that:
Absent some facts that the person disclosed some information about the subject matter of the pending lawsuit, granting carte blanche discovery of every litigant’s social media records is tantamount to a costly, time consuming fishing expedition.
