In a breach of contract action, the court denied plaintiff’s request to require defendants to hire a private electronic discovery vendor and/or reproduce documents in electronic format with accompanying metadata where defendant produced documents in hard copy format.
Plaintiff brought a breach of contract claim against defendants after defendants allegedly failed to pay for contracted goods. Plaintiff sought an order compelling the defendants to obtain an electronic discovery vendor based on alleged discovery violations related to electronically stored information (“ESI”), including:
- self-collecting of ESI by custodians;
- production of files in non-native format along with accompanying metadata;
- modification of documents; and
- failure to use a competent ediscovery vendor
Defendant modified documents by redacting customer names and personal information and then produced them in hard copy format. The court stated that although defendant should normally produce documents in electronic format, with the accompanying metadata, “if production is modest, then producing hard-copies may be less consequential.” But the court noted that all parties would most likely benefit from electronic, optical character recognition production.
The court also noted that the period when relevant documents were created was of a short duration, spanning only nine months, and that the “document universe is fairly limited.”
Because of these two factors, the court held that defendant was not required to obtain a private electronic discovery vendor. The court reasoned that “overspending on discovery risks creating litigation costs that are out of proportion to the possible returns.” The court ordered the parties to meet and confer. If the parties failed to reach an agreement, then the court ordered them to file letter briefs on any remaining ESI issues.
