Summary
The court found that American Bankers had failed to properly respond to the discovery requests, which included ESI. American Bankers had a sophisticated data base and computer which contained and could produce a great deal more information than was requested, but they failed to answer interrogatories and provide the requested documents. As a result, the court imposed sanctions and reversed and remanded the case for a new trial on unliquidated damages only.
