Summary   

Rule 1 was a largely overlooked rule until 2015 when the issues of cooperation, openness, and proportionality started to get new attention in the scope of discovery. The 2015 amendment added the words "and employed by the court and the parties" to emphasize the need for both litigants and judges to be proactive in their approach to discovery efforts with particular emphasis on keeping the costs and burdens of discovery in line with the value of the matter being adjudicated.

Scope and Purpose


These rules govern the procedure in all civil actions and proceedings in the United States district courts, except as stated in Rule 81. They should be construed, administered, and employed by the court and the parties to secure the just, speedy, and inexpensive determination of every action and proceeding.
